CLARIFICATION TEXT ON THE LAW ON THE PROTECTION OF PERSONAL DATA

 

As SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş., we have adopted a number of basic rules in order to fulfill our legal obligations with the utmost care and sensitivity, in order to provide better service to our valued customers, to protect the privacy of all your personal data you share and your fundamental rights and freedoms, especially the right of privacy. By acting in accordance with these basic rules, SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. aims to protect the rightful trust of its customers.

In accordance with the Law on Protection of Personal Data No. 6698 (“KVKK”), the text of this "Information Form" we, as SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş., have prepared as Data Controller, within the framework of Article 10 titled "Clarification Obligation of Data Controller" and 11 titled "Rights of Data Subject" in KVKK, contains information for what purpose your personal data will be processed, to whom and for what purpose your processed personal data can be transferred, the method and legal reason for the collection of your personal data, and about your rights to request information, correction and other rights regarding your personal data listed in Article 11 of the KVKK.

Any up-to-date information about you that you have shared with our company within the scope of KVKK shall be considered as "Personal Data”. These data shall be stored in accordance with the conditions stipulated by the legislation, in the most secure way possible, for the period required by legal obligations, in accordance with the legislation and the procedures and principles set forth below.

A) Data Controller

In accordance with the KVKK, your personal data may be processed by SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. as the "Data Controller" within the scope of what is explained below.

In accordance with the KVKK, your personal data that you have transmitted to SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. may be recorded, stored, maintained, updated, changed, edited, shared with third parties, classified and processed for the continuation of the service by SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. as the "Data Controller" within the scope of the purposes explained below and within the framework stipulated by the KVKK.

B) Which Personal Data Will Be Processed In Which Ways

Within the framework of your use of products and services of SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş., the following personal data are processed through our company headquarters and branches, our sales offices, our website and other channels:

  • Your personal identity data such as name, surname, TR Identity Number, date of birth, place of birth,
  • Your address, telephone number, e-mail address and other contact data,
  • All kinds of information about the product/service you purchased, including the information about the immovables, and your payment information regarding them,
  • Accounting and financial bank account information
  • Your other personal data that you personally transmit within the framework of your requests, suggestions and complaints,
  • If you use our websites, your behavior and digital trace information obtained through cookies,
  • Your voice call recordings kept in accordance with company standards,
  • Your camera recording images that occur when you visit our workplaces.
  • Your personal data of special nature for the work of the human resources department
  • Your photograph, criminal record, SGK information, license plate information
  • Diploma, professional qualification information and union membership information for employees and health data, which are personal data.

C) For What Purposes Your Personal Data Will Be Processed

Your personal data listed above may be processed for the following purposes and other similar purposes:

  • Communicating with you,
  • Performance of the agreements signed with the products and services offered,
  • Informing about products by means of e-mail and online advertising,
  • Presenting special campaigns and promotional activities related to our products/services and analysis of the data we process within this scope within the framework of statistical and planning activities,
  • Managing customer satisfaction and complaints, fulfilling requests sent through channels such as our sales offices, our website, etc., conducting customer satisfaction surveys,
  • Resolving problems with products and services,
  • Procurement of services from external sources such as the development of products and services and the acquisition of technology and infrastructure services,
  • In accordance with the relevant legislation, arrangement of mandatory information and documents within the framework of operation, storage and sharing of information requested by public institutions and organizations, fulfillment of notification obligations and fulfillment of other legal obligations,
  • Taking all necessary technical and administrative measures in order to ensure the security of our systems and applications,
  • Sharing information and documents that are essential for doing business with our business partners within the framework of the presentation and development of our products and services.

In addition, your personal data may be processed in accordance with the provisions of the Turkish Code of Obligations No. 6098, the Turkish Commercial Code No. 6102, the Law on the Protection of the Consumer No. 6502, the Law No. 6563 on the Regulation of Electronic Commerce and the secondary legislation regarding the laws listed, the obligations arising from the tax legislation and the conditions required by other authorized public authorities and the provisions of other relevant legislation, transferred to the physical and/or electronic archive and information systems of SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş., and kept in both digital and physical environment.

D) To Whom Your Personal Data May Be Transferred

Within the scope of the law and related legislation and for the purposes listed above, especially the parties below, your personal data mentioned above may be shared with our business partners in accordance with the law and honesty rules and by observing the principle of proportionality, by ensuring data security through confidentiality agreements that also contain provisions regarding data transfer:

  • Service providers and business partners that provide infrastructure and software support, whose services we benefit from and cooperate with,       
  • Official institutions and organizations such as regulatory and supervisory agencies,
  • Third parties we consult, including lawyers, tax advisers and auditors.

E) Legal Reasons for Processing Your Personal Data

In order to ensure that products and services are provided by SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. and that the rights and obligations regulated under the law are performed properly, your personal data is processed in line with the above-mentioned purposes and in full compliance with the principles set forth by the Law.

F) Your Rights as Personal Data Subject

You have the following rights under the law: learning whether your personal data is processed, requesting information if your personal data has been processed, learning the purpose of processing your personal data and whether they are used in accordance with its purpose, knowing the third parties to whom your personal data is transferred, in the country or abroad, and requesting correction of your personal data in case of incomplete or incorrect processing, requesting notification of third parties to whom personal data has been transferred, in case your personal data is incomplete or incorrectly processed, objecting to the possibility of unfavorable results in case your processed data is processed exclusively through automatic systems, requesting the compensation of the damage in case of damage due to unlawful processing of your personal data.

In this context, your requests included in your applications shall be concluded as soon as possible and free of charge, within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the fee in the tariff determined by the Board may be charged. If the application is made due to an error caused by SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş., the fee shall be refunded.

Pursuant to paragraph 1 of Article 13 of the KVKK, you may send your request regarding the exercise of your above-mentioned rights to SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. in writing or by other methods determined by the Personal Data Protection Board. Since the Personal Data Protection Board has not determined any method in the current situation, you must submit your application to SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. in writing in accordance with the KVKK. In this context, the channels and procedures to which you will submit your application in writing to SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. within the scope of Article 11 of the KVKK are explained.

In accordance with Article 13 of the KVKK, you may send your application request in writing to SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş.. You can send your request to the address ““İÇERENKÖY MAH. NO:2/5 ATAŞEHİR/İSTANBUL””, Customer Relations Department in person, via a notary public, by registered letter with return receipt or by e-mail to satemgrup@hs02.kep.tr e-mail address, by filling out the form on our website and adding your ID photocopy and other contact information.

SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. reserves the right to make changes in the application principles and the text of this information and consent letter due to the changes that may be made in the KVKK and other relevant legislation and the principles to be determined by the Personal Data Protection Board.

G) Clauses that do not Require Consent

Pursuant to paragraph 2 of Article 5 of the KVKK, provided that it is expressly provided for by law and is directly related to the conclusion or performance of an agreement, provided that it is necessary to process the personal data of the parties to the agreement, it is necessary for SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş. to fulfill its legal obligation as the data controller, and provided that it has been made public by the person concerned, data processing is mandatory for the establishment, exercise or protection of a right, provided that it does not harm the fundamental rights and freedoms of the data subject, SATEM GRUP GIDA DAĞITIM VE PAZARLAMA A.Ş., who is the data controller, has the right to process personal data without obtaining express consent in cases where data processing is necessary for its legitimate interests.
